General Terms and Conditions

1. Applicability

These general terms and conditions apply to all offers, quotations, and agreements between Radical Solutions (operating under the name SiteBuild.be), hereinafter referred to as "we" or "us", and our clients, hereinafter referred to as "you" or "the client".

By using our website or services, you agree to these terms and conditions. Deviations are only valid if confirmed by us in writing.

2. Services

SiteBuild.be provides professional web development services, including but not limited to:

• Development of websites and landing pages
• E-commerce solutions and webshops
• Custom web applications
• Website hosting and maintenance
• SEO optimization and consulting

The specific services, deliverables, deadlines, and pricing are defined in a separate quotation or agreement.

3. Quotations and Pricing

All quotations are non-binding and valid for 30 days unless stated otherwise. Prices are quoted in Euros (€) and exclude VAT unless explicitly stated.

3.1 Payment Terms

• 50% of the total amount upon project start (after quotation approval)
• 50% of the total amount upon project delivery

Payment must be made within 14 days of the invoice date by bank transfer to the account number provided on the invoice.

4. Project Execution and Deadlines

We aim to deliver all projects within the agreed timeframes. Indicative delivery times are:

• Landing Page: 3-7 business days
• Website Development: 5-10 business days
• Webshop Development: 30-45 business days

These timeframes depend on the timely provision of all required materials (texts, images, logos, etc.) by the client. Delays on the client's side may lead to adjusted timelines.

5. Intellectual Property

5.1 Copyright

All intellectual property rights to the websites, code, designs, and content we develop remain the property of Radical Solutions until the full agreed amount has been paid.

5.2 Transfer After Payment

Upon full payment, the intellectual property rights of the final product are transferred to the client, with the exception of:

• Reusable code components and frameworks
• Third-party plugins and libraries
• Template structures used across multiple projects

5.3 Portfolio Rights

We reserve the right to use the developed work in our portfolio and for marketing purposes unless otherwise agreed in writing.

6. Hosting and Domain

Our packages include 1 year of hosting and a .be domain. After the first year, costs are as follows:

• Hosting: from €10-30 per month (depending on resources)
• Domain renewal: €10-15 per year

No refunds are provided for unused hosting or domain services. You can transfer your website and domain to another provider at any time.

7. Maintenance and Support

7.1 Free Support

Each project includes basic post-launch support for technical questions and documentation. This support does not include new features or design changes.

7.2 Maintenance Packages (Optional)

For continuous support, we offer maintenance packages:

• Basic: €75/month - Security updates & backups
• Standard: €150/month - + Performance monitoring & minor adjustments
• Premium: €300/month - + Priority support & monthly updates

8. Warranty and Liability

8.1 Warranty

We guarantee that all delivered websites are functional and meet the agreed specifications at the time of delivery. Any bugs or technical issues reported within 30 days of delivery will be resolved free of charge.

8.2 Limitation of Liability

Our liability is limited to the amount you paid for the respective project. We are not liable for:

• Indirect or consequential damages
• Loss of profit or revenue
• Loss of data (except in cases of gross negligence on our part)
• Damage caused by third-party services, plugins, or hosting

9. Right of Withdrawal

9.1 No Right of Withdrawal for Services

In accordance with Belgian law and EU Directive 2011/83/EU, the right of withdrawal does not apply to our services because:

• We provide services that are fully performed with your explicit prior consent
• All websites and applications are custom-developed specifically for you
• We incur costs (domain, hosting, development) immediately upon project start
• The service begins immediately after signing the quotation

9.2 Cancellation

If a project is cancelled after the deposit is paid but before development begins, we reserve the right to:

• Charge any costs already incurred (domain, hosting setup)
• Charge a cancellation fee of 25% of the total project amount

If cancellation occurs during development, the full deposit remains due and any completed work will be invoiced proportionally.

10. Confidentiality and Privacy

We treat all information you share with us as confidential. Your data will only be used for the execution of our services and will not be shared with third parties without your consent.

11. Force Majeure

We are not liable for delays or failures in fulfilling our obligations due to force majeure, including but not limited to:

• Natural disasters or extreme weather conditions
• War, terrorism, or government actions
• Internet or hosting provider outages
• Strikes or other labor disputes
• Illness or other unforeseen circumstances

12. Changes to Terms

We reserve the right to amend these terms and conditions. Changes will take effect upon publication on our website. For ongoing projects, the terms in effect at the time of agreement will continue to apply.

13. Governing Law and Disputes

All agreements are governed by Belgian law. Any disputes will initially be submitted to the competent court in Belgium, unless mandatory legal provisions dictate otherwise.

We aim to resolve any disputes amicably before taking legal action.
